Authorization:
Pursuant to SDCL 49-16B-3, this board also functions as the Rail Authority. Chapters 1-44 and 49-16B of the South Dakota Codified Laws.
Activities:
Grants approval to the Department of Transportation in the matters of operation, management, finance, marketing, and development of rail service over all properties and facilities acquired, leased or controlled by the state.
S.D. Railroad Authority Activities: The South Dakota Railroad Board also serves as the South Dakota Railroad Authority. Under South Dakota Codified Law 49-16B-10, the South Dakota Railroad Authority may: (1) plan, establish, acquire, develop, construct, purchase, enlarge, maintain, equip, and protect railroads and railroad facilities, including railroad rolling stock and, for such purposes, may acquire real or personal property; (2) conduct continuous studies into the need for such facilities; and (3) serve the Legislature by making reports and recommendations concerning the providing of such facilities. South Dakota Codified Law 49-16B-24 authorizes the South Dakota Railroad Authority to borrow money and issue and sell bonds to accomplish this work.
Organization:
Administered within the Department of Transportation.
Composition:
Seven members appointed by the Governor. No more than five from the same political party. At least
one member, in the opinion of the Governor, shall be a person experienced in or having a favorable
reputation or skill, knowledge and experience in the following fields:
(1) Business management;
(2) Operation of railroad service;
(3) Private or public finance;
(4) Marketing;
(5) User of rail service; and,
(6) Two members at large.
Term of Appointment:
Terms shall expire on October 30 on the third year of appointment.
Frequency of Meetings:
3rd Wednesday of each month.
