Section 1-40-25 of the South Dakota Codified Laws
Activities:
Promulgates rules and issues permits in the following areas: Air quality, solid waste, hazardous waste, mining, and oil and gas exploration and production activities.
Organization:
Administered under Department of Agriculture and Natural Resources. Board retains quasi-judicial,
quasi-legislative functions in the environmental areas noted above
Composition:
Nine members appointed by the Governor. Not all from the same political party. (Requirements of the
Clean Air Act are that a majority of the members do not represent a business or industry which is
regulated by the board.)

Four Years

Ten times per year or as needed
